The bench passed the order on an appeal filed by the State government questioning the correctness of the single judge’s verdict.
A division bench of the High Court of Karnataka on March 7 gave green signal to the State government to conduct board exams for the summative assessment of students of classes 5,8 and 9 as per the schedule, beginning from March 11.
The bench comprising Justice K. Somashekar and Justice Rajesh Rai K passed the interim order by staying the March 6 judgment of a single judge. The bench passed the order on an appeal filed by the State government questioning the correctness of the single judge’s verdict.
The single judge had quashed the State government’s decision to hold board exams for classes 5, 8, 9, and 11 from the academic year 2023-24 while declaring that said decision was taken without following the due process of law as prescribed under the provisions of the Karnataka Education Act, 1983. Though the single judge had also quashed decision of the Government to hold annual exam for class 11 through the KSEAB, the exams for the present academic year was already concluded on February 28.

ಏಕಸದಸ್ಯ ನ್ಯಾಯಾಧೀಶರ ತೀರ್ಪಿನ ಸರಿಯಾದತೆಯನ್ನು ಪ್ರಶ್ನಿಸಿ ರಾಜ್ಯ ಸರ್ಕಾರ ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಯ ಮೇರೆಗೆ ಪೀಠವು ಈ ಆದೇಶ ನೀಡಿದೆ.
ಮಾರ್ಚ್ 7 ರಂದು ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್‌ನ ವಿಭಾಗೀಯ ಪೀಠವು ಮಾರ್ಚ್ 11 ರಿಂದ ಪ್ರಾರಂಭವಾಗುವ ವೇಳಾಪಟ್ಟಿಯ ಪ್ರಕಾರ 5,8 ಮತ್ತು 9 ನೇ ತರಗತಿಗಳ ವಿದ್ಯಾರ್ಥಿಗಳ ಸಂಕಲನಾತ್ಮಕ ಮೌಲ್ಯಮಾಪನಕ್ಕಾಗಿ ಬೋರ್ಡ್ ಪರೀಕ್ಷೆಗಳನ್ನು ನಡೆಸಲು ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಹಸಿರು ನಿಶಾನೆ ತೋರಿತು.
ನ್ಯಾಯಮೂರ್ತಿ ಕೆ.ಸೋಮಶೇಖರ್ ಮತ್ತು ನ್ಯಾಯಮೂರ್ತಿ ರಾಜೇಶ್ ರೈ ಕೆ ಅವರನ್ನೊಳಗೊಂಡ ನ್ಯಾಯಪೀಠ ಮಾರ್ಚ್ 6 ರಂದು ಏಕಸದಸ್ಯ ನ್ಯಾಯಾಧೀಶರ ತೀರ್ಪಿಗೆ ತಡೆ ನೀಡಿ ಮಧ್ಯಂತರ ಆದೇಶ ನೀಡಿದೆ. ಏಕಸದಸ್ಯ ನ್ಯಾಯಾಧೀಶರ ತೀರ್ಪಿನ ಸರಿಯಾದತೆಯನ್ನು ಪ್ರಶ್ನಿಸಿ ರಾಜ್ಯ ಸರ್ಕಾರ ಸಲ್ಲಿಸಿದ ಮೇಲ್ಮನವಿಯ ಮೇರೆಗೆ ಪೀಠವು ಈ ಆದೇಶ ನೀಡಿದೆ.
2023-24 ನೇ ಶೈಕ್ಷಣಿಕ ವರ್ಷದಿಂದ 5, 8, 9 ಮತ್ತು 11 ನೇ ತರಗತಿಗಳಿಗೆ ಬೋರ್ಡ್ ಪರೀಕ್ಷೆಗಳನ್ನು ನಡೆಸುವ ರಾಜ್ಯ ಸರ್ಕಾರದ ನಿರ್ಧಾರವನ್ನು ಏಕಾಂಗಿ ನ್ಯಾಯಾಧೀಶರು ರದ್ದುಗೊಳಿಸಿದರು ಮತ್ತು ನಿಬಂಧನೆಗಳ ಅಡಿಯಲ್ಲಿ ನಿಗದಿಪಡಿಸಿದಂತೆ ಕಾನೂನು ಪ್ರಕ್ರಿಯೆಯನ್ನು ಅನುಸರಿಸದೆ ನಿರ್ಧಾರ ತೆಗೆದುಕೊಳ್ಳಲಾಗಿದೆ ಎಂದು ಘೋಷಿಸಿದರು. ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯಿದೆ, 1983. ಏಕ ನ್ಯಾಯಾಧೀಶರು KSEAB ಮೂಲಕ 11 ನೇ ತರಗತಿಗೆ ವಾರ್ಷಿಕ ಪರೀಕ್ಷೆಯನ್ನು ನಡೆಸುವ ಸರ್ಕಾರದ ನಿರ್ಧಾರವನ್ನು ರದ್ದುಗೊಳಿಸಿದ್ದರೂ, ಪ್ರಸ್ತುತ ಶೈಕ್ಷಣಿಕ ವರ್ಷದ ಪರೀಕ್ಷೆಗಳನ್ನು ಈಗಾಗಲೇ ಫೆಬ್ರವರಿ 28 ರಂದು ಮುಕ್ತಾಯಗೊಳಿಸಲಾಗಿದೆ.
